Legal Actions Targeting Banks with Epstein Connections Could Reveal Fresh Insights on Billionaire’s Crimes

Over many years, survivors of Jeffrey Epstein have demanded accountability. At one point, it seemed like they would get it.

Ghislaine Maxwell, Epstein’s ex-girlfriend, was convicted of human trafficking in a 2021 trial for her involvement in the deceased billionaire’s sexual abuse of teen girls – and sentenced to 20 years imprisonment.

Meanwhile, financial firms that had done business with Epstein, while not accepting fault, agreed to pay substantial sums in agreements to survivors. Former President Trump even made releasing the documents related to the Epstein probe part of his election promises, and doubled down on his promise to do so in recent months.

Ultimately, Trump’s justice department did not release these files, and his government has become involved in reports about social ties between him and Epstein. Congressional promises to disclose documents have stalled, due to political jockeying and justice department foot-dragging.

However recent legal actions could shed light on Epstein’s activities amid the deadlock – regardless of their outcome.

Lawsuits Aim at Leading Financial Institutions

The legal complaints, submitted by an anonymous plaintiff against Bank of America and the BNY Mellon, claim that these financial powerhouses illicitly enabled Epstein’s sex trafficking. The cases are helmed by Sigrid S McCawley, of a prominent law firm, and lawyer Brad Edwards of his legal practice, who have consistently advocated for survivors of Epstein’s abuse.

“Epstein committed these crimes by means of not only his own vast fortune and power, but through financial backing and monetary assistance from both private parties and organizations, including BNY,” one lawsuit states. “Shockingly, the institution had a abundance of knowledge regarding Epstein’s trafficking network but opted for financial gain over protecting the victims.”

The complaint against Bank of America mirrors these claims, declaring the institution “knowingly provided the monetary resources and the appearance of respectability for Epstein and his accomplices to support their international sex trafficking organization under the guise of legal commercial dealings”. The suit also said the bank neglected to file suspicious activity reports.

Legal Experts Weigh In on Legal Hurdles

Longtime attorneys who spoke to the situation said establishing liability would be challenging. But they also noted potential results which could provide solace to accusers or release of long-sought information.

Neama Rahmani, a former federal prosecutor who founded West Coast Trial lawyers, said evidence has to show that an bank’s conduct resulted in harm.

“In my view, the case faces significant obstacles – and obviously I am on the side of the victims, and I want them to get explanations and criminal justice and financial recovery,” Rahmani said. Some claims might be not directly related from a juridical perspective.

“The case hinges on proof,” Rahmani said. A lawyer would need to prove cause and effect, which would mean “but for the defendant’s conduct, the injury wouldn’t have occurred”. In this case, that would translate to “absent the institution’s involvement, the survivor maybe wouldn’t have been exploited”, Rahmani clarified.

An attorney would also have to go beyond a basic causation test. “Is not just ‘but for’ causation. It also has to be a significant element: that is the legal test. So any improper behavior there was, if there was any misconduct … the bank’s actions has to have been a key contributor in leading to the plaintiff harm.

“Through maintaining financial ties to Epstein, is that a substantial factor? It’s uncertain.”

Regardless of legal responsibility, suits like this could serve as a warning that relationships with those involved in alleged crimes can have damaging implications for them.

“It’s a PR nightmare,” Rahmani noted. If the financial institutions try to get these suits dismissed and fail, Rahmani expects a swift settlement. “No party desires to pursue any of the Epstein-related cases.”

Attorney Eric Faddis, a trial attorney and principal of the Colorado law firm his firm and ex-government lawyer, said companies can be liable. In this scenario, “if the institutions bear fault is going to depend, in part, on what the banks knew, if they were informed of claimed misconduct or illegal acts”, and in some way offered support to Epstein.

“However, even in that case, I think it’s going to be hard to effectively connect the banks into some kind of sex-trafficking scheme. The institutions would likely not be privy to the details of allegations,” the lawyer said. While the financier’s prior legal case was known, “there’s no law against for a financial institution to have a customer who’s an unsavory person”.

“However, it is unlawful for a bank to in any way be involved in the illegal actions of a client, but those two issues are very different, and so I think that it’s going to be a tough lawsuit against the banks.”

Potential Benefits for Survivors

Nevertheless, important aspects of the legal proceedings could assist those affected by Epstein.

“The lawsuits have the potential to reveal more information about the continuing Epstein story,” the attorney said. “Even though there have been obstacles erected at every turn for individuals seeking this information, when there’s a lawsuit, there’s a evidence-gathering phase, and that legal procedure often requires disclosure of materials that was not previously public.”

Attorney Brad Edwards said in a statement that the lawsuits could have a preventive impact and achieve what lawmakers have failed to do.

“The lawsuits are necessary for complete justice for the survivors of Jeffrey Epstein – as well as for potential targets who will suffer from comparable criminal networks – if our banks are not held accountable for the essential role each plays, either in supplying the necessary infrastructure for the criminal enterprise or identifying the monetary aspect of these offenses and putting an end to it.

Edwards continued: “We have a far better chance of effecting meaningful change than Congress, because we understand the facts and history of the matter and are not motivated by politics but rather by a sincere intention to make a real difference and to safeguard the survivors, who have already suffered tremendously.

“We approach these matters without any political agenda and thus cannot be deterred by obstructions, shielding influential figures, or the other embarrassing partisan gamesmanship you and the rest of the world have had to observe recently.”

Attorney Sigrid McCawley said in a statement: “While legislators attempt to uncover how the financier was able to orchestrate his illegal trafficking operation for decades without detection, we are taking a further significant action forward toward justice for survivors.”

Institutional Reactions

When requested for a statement on the legal complaint, BNY said: “The claims in the lawsuit are meritless, and we will vigorously defend against it.”

The bank’s response likewise stated: “We will vigorously defend ourselves in this case.”
